GDPR AND DATA PROTECTION RIGHTS
YOUR RIGHTS UNDER EU DATA PROTECTION LAW

Last updated: July 11, 2026

This page summarizes rights that may be available to users in the European Union, including Germany, under the General Data Protection Regulation ("GDPR"). It should be read together with our Privacy Policy, Cookie Policy, Terms of Use, and other legal notices.

To exercise a data protection right, contact us at sales@proximai.art. Please use the email address connected to your account where possible so we can verify the request.

1. WHO CAN USE THESE RIGHTS

If the GDPR applies to the processing of your personal data, you may have the rights described below. These rights are not absolute and may be limited by law, security requirements, the rights of other people, accounting duties, fraud prevention, content moderation, or legal claims.

2. RIGHT OF ACCESS

You may request confirmation of whether we process your personal data and request a copy of that data, together with information about purposes, categories, recipients, retention, sources, and safeguards for international transfers.

3. RIGHT TO RECTIFICATION

You may request correction of inaccurate personal data and completion of incomplete personal data. Some account information can be corrected directly in your account settings where available.

4. RIGHT TO ERASURE

You may request deletion of personal data where the GDPR gives you that right, for example where data is no longer necessary, consent is withdrawn, processing was unlawful, or deletion is required by law.

Deletion may be limited where we need to keep data for payment records, tax compliance, security logs, fraud prevention, dispute resolution, content moderation, legal claims, or protection of other users.

5. RIGHT TO RESTRICTION

You may request that we restrict processing in certain situations, for example while we verify contested accuracy, assess an objection, or preserve data for legal claims.

6. RIGHT TO DATA PORTABILITY

Where processing is based on consent or contract and carried out by automated means, you may request personal data that you provided to us in a structured, commonly used, machine-readable format, where technically feasible and legally required.

7. RIGHT TO OBJECT

You may object to processing based on legitimate interests. If you object, we will stop processing unless we have compelling legitimate grounds that override your interests, rights, and freedoms, or the processing is needed for legal claims.

You may object to direct marketing at any time.

8. WITHDRAWING CONSENT

Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect processing that occurred before withdrawal and does not affect processing based on another legal basis.

9. AUTOMATED DECISION-MAKING

The Services may use automated systems for generation, moderation, abuse prevention, fraud checks, queue management, and safety filtering. We do not intend to use the Services for automated decisions that produce legal or similarly significant effects about you without a lawful basis and required safeguards.

10. HOW TO SUBMIT A REQUEST
  • Email: send your request to sales@proximai.art.
  • Verification: we may ask for information needed to verify your identity and protect your account.
  • Scope: describe the right you want to exercise and the data or account involved.
  • Timing: we aim to respond within the time required by law. Complex or numerous requests may take longer where the law allows an extension.
11. COMPLAINTS

You may lodge a complaint with a competent data protection supervisory authority, including the authority in the EU member state where you live, work, or believe a GDPR infringement occurred.
